Terms and Conditions

These Terms & Conditions (“Terms”) apply to all bookings with memovox. By confirming a booking, you agree to these terms.

1. Booking & Payment

A booking is confirmed once full payment of the booking fee is received.

The total booking fee covers your selected event date and includes hire of the memovox kit and related services.

Payment must be made at the time of booking unless otherwise agreed in writing.

All prices are stated in AUD and may include GST where applicable.

2. Delivery & Collection

Delivery and collection are included within 30km of Melbourne CBD (VIC 3000). Locations outside this area may incur additional fees or may not be available, and will be confirmed at the time of booking.

We aim to deliver your kit 2 to 3 days before your event and collect it the next business day after your event, unless otherwise agreed.

Delivery times are arranged in advance, but exact timing may vary depending on logistics and venue access.

You are responsible for ensuring access is available for both delivery and collection. If access is not available, a re-delivery or re-collection fee may apply.

3. Equipment & Inventory

Each memovox kit includes:

  • 1 × memovox phone (fully charged)
  • 1 × signage
  • 1 × signage stand 
  • 1 × storage bag 
  • Printed instruction and welcome materials (these are yours to keep)

Return requirement

The phone, signage, stand, and storage bag must all be returned in good condition.

At collection, the kit will be checked against this list.

4. Use of Equipment

The kit is for use at your booked event only and must not be sub-rented, loaned, or modified.

You must not open, repair, or alter any equipment.

The kit should be used indoors or in a sheltered area, away from liquids, direct heat, or conditions that may damage the equipment.

You are responsible for the safe use of the kit during your event.

Where children are present, reasonable supervision is required to prevent damage or misuse.

You are responsible for loss or damage caused by misuse or negligence by guests or third parties at your event, to the extent permitted by law.

5. Return of Kit & “Good Condition” Definition

The following items must be returned:

  • 1 × memovox phone (with SD card inside)
  • 1 × signage
  • 1 × signage stand
  • 1 × storage bag

Printed materials are yours to keep.

Good condition means:

Items are:

  • Clean and dry, free from food, liquids, tape, glitter, wax, or residue
  • Fully functional and able to power on, record, and play back audio
  • Free from damage beyond normal wear and tear
  • Complete, with no missing parts or modifications

Normal wear and tear means minor surface marks that do not affect function.

Return options

Collection: The kit must be available at the agreed time and location. If access is not available, a re-collection fee may apply.

Post return: If using a prepaid Australia Post label, the kit must be lodged within 2 business days after your event. You must keep your tracking receipt.

Prepaid label option: If you choose our label, you must lodge the kit with Australia Post within 2 business days after your event and retain/provide the lodgement receipt (with tracking number).

Risk of loss transfers once Australia Post confirms lodgement via tracking scan. If using another carrier, risk transfers when the kit is received by us.

Late & non-return

If the kit is not returned or lodged within 7 days of the scheduled return date and no extension has been agreed in writing, we may treat the kit as lost and charge the replacement cost under Section 6.

6. Security Hold, Loss & Damage

A $150 security hold will be placed on your nominated card at booking. This is a pre-authorisation only and will be released once the kit is returned in good condition (see Section 5).

Missing, damaged, or dirty items

If any return-required item is missing, damaged, or returned in a condition requiring extra cleaning, we may deduct the reasonable cost of repair, replacement, or cleaning from the hold.

If costs exceed $150, we will invoice you for the balance. Invoices must be paid within 7 days of issue.

Non-return

If the kit (or any item) is not returned within 7 days of the scheduled return date and no extension has been agreed in writing, we may treat it as lost and charge the reasonable replacement value.

Recovery of costs

If you do not pay an invoice when due, we may take reasonable steps to recover the debt, including engaging debt collection services or court action. You will be liable for any reasonable recovery costs incurred.

7. Recordings, Data & Privacy

Ownership

All recordings made on the device belong to you.

Transfer

We will provide digital copies of your recordings within 6 business days after receiving the returned kit.

Backup & deletion

We may retain a secure backup for up to 14 days after delivery in case recovery is needed, after which files are permanently deleted.

Privacy

We do not access, share, or use recordings for any purpose other than delivering your files, unless required by law.

Limitations & responsibility

You are responsible for how guests use the device during your event, including following instructions provided with the kit.

We take reasonable care in handling and transferring recordings but cannot guarantee against loss, corruption, or reduced quality caused by misuse, venue conditions, or technical issues outside our control, except where caused by equipment fault.

8. Cancellations & Refunds

Cancellation

If you cancel more than 14 days before your event, you will receive a full refund.

If you cancel within 14 days of your event, payments are non-refundable. Your date is reserved exclusively for you, and we are unable to rebook that time.

Reschedules

You may request one reschedule at no charge if requested at least 14 days before your event, subject to availability.

Rescheduled events must take place within 12 months of the original date.

Reschedule requests do not override cancellation terms unless confirmed in writing.

Further reschedules may incur a fee.

Our cancellation

If we are unable to provide the service for reasons within our control, you will receive a full refund.

If we cannot fulfill the booking due to events outside our reasonable control (including but not limited to natural disasters, transport disruptions, or government restrictions), we may offer a refund, credit, or reschedule.

Liability

Our liability for cancellations is limited to the total amount you paid for your booking.

9. Liability & Risk

To the extent permitted by law, we are not liable for:

  • Loss, corruption, or reduced quality of recordings caused by guest use, venue conditions, or third parties
  • Personal injury or property damage arising from use of the kit, except where caused by our negligence
  • Indirect or consequential loss, including loss of enjoyment or emotional impact

Our total liability for any claim is limited to the amount paid for your booking.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law.

You agree to indemnify us against claims arising from misuse of the kit by you, your guests, or third parties at your event, except where caused by our negligence.

10. Force Majeure

We are not responsible for delays or failure to deliver services caused by events outside our reasonable control.

If this occurs, we will offer a refund, credit, or reschedule option, acting reasonably in the circumstances.

11. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve it through direct communication in good faith before starting legal proceedings.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the courts of Victoria.
